"not to play or use.. any musical instrument or sound reproduction
equipment or television loudspeaker or mechanical instrument of any kind
between the hours of 12 midnight and 8 am, nor sing or carry on loud
conversation ...so as too cause damage nuisance or annoyance ...to the
occupiers of any neighbouring or adjoining property" What YOU
must do: 1. Make
a record of the noise violation - date, time started and stopped, a
description and a precise source 2. Make
an attempt to have the noise stopped directly by the creator - but DON'T put
yourself in any danger 3. Report

you suffer any harassment or there is likely to be a breach of the peace,
phone the local Police 5. Report

can only help you if you help yourself first From the managing agent: In the first instance I
can serve this gentleman with a breach notice. If the incident was
reported to the police and a police crime number can be forwarded to me, I
can use this as evidence of a breach and serve notice of intention to forfeit
the lease (this usually happens when the second incident is reported and I
believe we have had one complaint to the office already). Most lessees or landlords
who rent out their flats take this threat very seriously and either evict
troublesome tenants or tone down their behaviour. It is always explained to
them that this breach will remain on file and may prevent them selling their
flat at a later date or possibly affect the price. A breach must be addressed
within a certain time frame and no further recorded incidents must take place
following the breach notice or I will begin the forfeiture process. This is not an easy
process but will scare the pants off the leasehold owner. I attach a copy of
a breach notice and if the gentleman sends me full details of the incident -
police incident no., name of policeman who took statement and any other
supporting evidence I will issue the same letter to the leaseholder of the
flat. sample letter

Ferry Quays, Brentford, Middlesex TW8 As you know, we are the
Managing Agent of the block, of which the above flat forms part. Under
the provisions of the Lease the occupiers of the property are required to observe
certain obligations. It is necessary for such obligations to be in
force where people are living in proximity to each other, as in the case of
flats. We understand from several
adjoining property owners that they are being disturbed by excessively loud
noise emanating from your property particularly at night after 11pm.
It would therefore be
appreciated if you could reduce all noise levels so as to avoid any
disturbance to the adjoining property owners. We would point out that under
the provisions of the Lease, if the noise does persist, the adjoining
property owners do have the legal right to take action against you so that
they may continue to enjoy their property. Hopefully however, this will
not be necessary and we would be obliged if you could please co-operate in
this regard.
We trust therefore that you
will ensure that you continue to occupy the property in accordance with the
terms of the Lease, so as to avoid further action being taken against you.
